ASSUMPTION OF RISK, AND HOLD HARMLESS AGREEMENT
By registering for the Speak Their Names Foundation’s Memorial Hike and checking the acknowledgment box on the registration form, I acknowledge and agree to the following terms as a condition of my participation in this event and any associated activities held aboard Marine Corps Base Camp Pendleton, California (“the Installation”):
- Assumption of Risk.
I understand that access to and activities on the Installation, including but not limited to hiking, involve inherent risks including uneven terrain, weather exposure, wildlife, military equipment or operations, restricted or hazardous areas, and unforeseen accidents. I voluntarily assume all such risks, known and unknown, and elect to participate despite these risks. - Release and Hold Harmless.
I release, waive, discharge, and covenant not to sue the United States Government, the Department of Defense, the United States Marine Corps, Marine Corps Base Camp Pendleton, and their officers, agents, and employees, as well as the Speak Their Names Foundation, its board, staff, and volunteers (collectively “Releasees”), from any and all liability, claims, demands, losses, or damages arising out of or connected with my participation in this event or associated activities, including claims arising from the negligence of the Releasees, to the fullest extent permitted by law. - Indemnification.
I agree to indemnify and hold harmless the Releasees from any loss, liability, damage, or cost, including attorney’s fees, that the Releasees may incur due to my participation in this event. - Base Access Compliance.
I understand that Marine Corps Base Camp Pendleton is a secure military installation and that access requires a valid DBIDS pass or other approved credential obtained through the base Visitor Center or electronic sponsorship process. I understand this event is sponsored for base access purposes by the 1st Marine Regiment, and that Speak Their Names Foundation is acting solely as the event organizer and coordinator, not as the installation sponsor. I agree to comply with all installation access, security, identification, and safety requirements, and I understand that failure to comply may result in denial of entry, debarment, or loss of future access privileges for myself. I understand that, per installation policy, sponsoring units are responsible for the conduct of their guests while aboard the Installation, and I agree to conduct myself accordingly and to hold both the 1st Marine Regiment and Speak Their Names Foundation harmless for my own conduct violations. - Responsibility for Minors.
If I am registering on behalf of, or bringing, any minor(s) (under age 18) to this event, I represent that I am the parent or legal guardian of such minor(s), or have been authorized by the parent/legal guardian to act on their behalf. I acknowledge and agree that I am fully responsible for the supervision, safety, and conduct of any minor(s) in my care throughout the event and any associated activities, including the hike. I agree that this Release of Liability, Assumption of Risk, and Hold Harmless Agreement applies fully to each minor in my care, and I accept and agree to all its terms on their behalf, including the assumption of risk and release of the Releasees from liability for any injury or loss the minor may incur. - Medical Treatment Authorization.
I authorize Speak Their Name Foundation and installation personnel to secure emergency medical treatment for me (or any minor in my care) if needed, and I accept financial responsibility for such treatment. - Electronic Signature.
I understand that checking the acknowledgment box on the registration form constitutes my electronic signature and legally binding acceptance of this agreement, with the same effect as a handwritten signature. - Voluntary Agreement.
My participation, and that of any minor(s) in my care, is entirely voluntary. I have read this document in its entirety, understand its terms, and agree to them voluntarily. - Severability.
If any provision of this agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
